Terms and Conditions

Application

These General Terms and Conditions of Sale apply to all VTC transport services booked with TOPCHAUFFEUR.

Booking

The service is booked for a fixed date via the website, by telephone or by email. The booking becomes firm upon written confirmation from TOPCHAUFFEUR.

Price and payment

Prices are indicated in euros including VAT. Payment is made directly to the driver at the end of the service. Accepted payment methods: bank card and cash.

Cancellation and no-show

Cancellation by the Client: free of charge up to 24 hours before the service. Beyond this period, the full price is due.

No-show: if the Client is absent at the pickup location without notice after 15 minutes of waiting, the service is charged in full.

Cancellation by TOPCHAUFFEUR: in case of force majeure, TOPCHAUFFEUR informs the Client as soon as possible and refunds all amounts paid.

Service execution

The service is provided by the President of the company or by an authorised VTC driver holding a valid licence and professional insurance. The Client is informed of the driver's identity at the time of booking confirmation. The Client undertakes to be present at the pickup location at the agreed time. Luggage must comply with the capacity of the reserved vehicle.

Conformity guarantee

In accordance with Articles L.211-4 et seq. of the French Consumer Code, TOPCHAUFFEUR guarantees the conformity of the service to the contract.

Liability

TOPCHAUFFEUR's liability is limited to direct and foreseeable damages, within the limit applicable to land passenger transport. TOPCHAUFFEUR shall not be liable for delays attributable to external circumstances (traffic, weather, strikes). The transport of dangerous goods, illicit substances or persons presenting a danger is prohibited.

Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to passenger transport services booked for a specific date.

Consumer mediation

In accordance with Articles L.611-1 et seq. of the French Consumer Code, the Client may have recourse free of charge to the Transport Mediator: www.mediateur-transport.fr

Applicable law and jurisdiction

These General Terms and Conditions are subject to French law. In the event of a dispute, the French courts shall have jurisdiction.
